Terms of Use and Sale
Applicable to the Un peu mystique website, digital content, AI interpretations, paid features and membership services · Last updated: September 25, 2026
Operator and scope
This website and its associated digital services are operated by the French company Falpes SARL. These Terms apply to users who access, register for, purchase or otherwise use the Un peu mystique / 有点玄 website, applications, digital content, AI interpretations, memberships and other related features.
By using the service or completing a purchase, you accept the version of these Terms applicable at the time of purchase. These Terms do not affect any consumer rights that cannot lawfully be excluded or limited by contract.
Nature of the service: I Ching, divination and personal reflection
This service draws on the I Ching, traditional symbolic and numerical systems, or related cultural materials to provide random draws, text displays, explanations, interactive content and certain interpretations generated with the assistance of artificial intelligence.
Terms such as “divination”, “prediction”, “good or bad fortune” and “luck” are used in the context of the product experience, traditional culture or entertainment. They do not imply that Falpes SARL can actually predict the future, nor do they constitute a statement, promise or guarantee that any event will necessarily occur.
- Results are symbolic, interpretative and subjective, and carry no scientific, medical, statistical or factual predictive guarantee.
- Asking the same question at different times may produce different results.
- Users should not rely solely on divination results to make decisions that could materially affect their own or others’ health, property, safety, legal rights or significant personal interests.
AI-generated content
Some explanations, summaries, suggestions or written content may be generated automatically by artificial intelligence systems. When using the relevant features, users should be aware that they are receiving AI-generated or AI-assisted content.
AI outputs are generated from user-provided content, I Ching materials and system context. AI may produce factual errors, omissions, incorrect inferences, inconsistencies, outdated information or entirely fabricated content.
- AI content is not provided by doctors, psychotherapists, lawyers, accountants, investment advisers or other licensed professionals.
- AI outputs must not be treated as diagnoses, treatment recommendations, legal opinions, investment advice, credit assessments, hiring decisions, safety assessments or any similar professional advice.
- Falpes SARL does not guarantee that AI outputs are complete, accurate, unique, objective or suitable for the user’s particular circumstances.
- If an AI output conflicts with professional advice, legal requirements, safety requirements or real-world facts, reliable professional advice, official information and real-world evidence should take precedence.
Prohibited use for high-risk or emergency decisions
This service must not be used as a tool for emergencies or major high-risk decisions.
- It must not be used to decide whether to stop, delay or change medical treatment or psychotherapy.
- It must not be used for decisions involving self-harm, suicide, violence, dangerous conduct or other actions that could endanger life or safety.
- It must not be used for investment, lending, borrowing, gambling, major financial transactions or tax decisions.
- It must not be used to decide matters involving marriage, divorce, guardianship, custody, litigation, immigration or other major legal issues.
- It must not be used to assess another person’s criminal tendencies, health, loyalty, true character or other facts that this service cannot reliably determine.
- In a health, safety or mental health emergency, contact local emergency services or an appropriately qualified professional immediately.
Age, accounts and account security
This service is intended for users aged 18 or over. Registered users must provide truthful, accurate and up-to-date account information and are responsible for their account credentials and activities under their account for which they can reasonably be held responsible.
You must not impersonate others, use another person’s account without authorisation or use the service to infringe third-party rights.
If we have reasonable grounds to believe that an account is being misused or involves fraud, security risks, unlawful activity or a serious breach of these Terms, we may take reasonable steps to restrict or suspend the relevant features, subject to any legal requirement to provide notice or an opportunity to remedy the issue.
User questions and inputs
You retain the rights you lawfully hold in the content you submit. You grant Falpes SARL a non-exclusive right to use that content to the extent necessary to provide, protect, maintain and technically process the services you request.
Do not include unnecessary identity document numbers, payment card details, medical records, third parties’ private information or other highly sensitive personal information in your questions.
- You must ensure that you have the right to submit the content you enter.
- You must not submit content that is unlawful, threatening, hateful, seriously harassing, invasive of privacy, infringing of intellectual property rights or intended to facilitate unlawful acts.
- For questions involving third parties, no content generated by the system may be regarded as evidence of that person’s actual thoughts, health, actions, intentions or future behaviour.
Prices, orders and payments
The price, currency, included content, number of available uses, validity period and applicable conditions of paid features are those displayed on the purchase page before the order is confirmed.
Payments are processed by the third-party payment service providers displayed on the website. Except for features permitted by the payment service provider and expressly offered on the website, Falpes SARL does not directly store full payment card numbers.
An order is formed only after payment has been successfully completed and confirmed by the system. If a transaction cannot be completed because of a bank declining payment, fraud detection, an obvious pricing error or a technical anomaly, we may withhold the corresponding paid content and will refund, in accordance with the law, any amount actually collected for services not provided.
Consumer right of withdrawal and immediate supply of digital content
Consumers in the EU and France generally have a statutory right of withdrawal from distance contracts. For digital content not supplied on a tangible medium, this right may cease once the statutory conditions are met if the user expressly requests that supply begin immediately, before the withdrawal period expires, and expressly acknowledges that the corresponding right of withdrawal will be lost once supply begins.
Accordingly, for divination results, AI interpretations or similar digital content generated or delivered immediately, we will, where applicable, ask users to provide the necessary express acknowledgement before payment. This acknowledgement does not exclude statutory guarantees of conformity for digital content, remedies for failure to provide the service or other non-waivable consumer rights.
Refunds, technical faults and statutory guarantees
Subject to consumers’ statutory withdrawal rights, statutory guarantees of conformity and other mandatory rights, personalised instant digital content that has been properly generated, delivered or consumed is generally not eligible for a discretionary refund solely because the user is dissatisfied with the interpretation, the result does not meet expectations or the user changes their mind.
If a technical fault attributable to us means that paid content is not actually provided, is substantially incomplete or cannot be accessed normally, please contact us. Depending on the circumstances, we may provide the service again, restore usage credits, fix the issue or issue a refund in accordance with applicable law.
These Terms do not limit the application of the French Consumer Code provisions on statutory guarantees of conformity for digital content and digital services.
Memberships, usage credits and subscriptions
If a product includes a membership period, a number of uses or other allowances, the quantities, duration and conditions of use are those stated in the product description displayed at the time of purchase.
Used credits are not automatically restored because of subjective dissatisfaction with the generated result, except where a confirmed technical fault prevented the feature from being properly provided.
If we offer automatically renewing subscriptions in the future, the renewal cycle, price, cancellation method and effective date will be clearly displayed before purchase. For any contract that can be concluded online and is subject to French consumer cancellation rules, we will provide the online cancellation method required by law.
Intellectual property
The website’s source code, interface, brands, trademarks, database structure, graphic design, original text, compiled content and other protected materials belong to Falpes SARL or the relevant rights holders to the extent permitted by law.
Unless permitted by law or authorised in writing, users must not engage in large-scale copying, scraping, resale, mirroring, reverse engineering or reuse of website content in a competing database.
Users may save results they have lawfully obtained for personal, non-commercial use. This does not grant ownership of the website’s underlying databases, software, brands or third-party works.
Prohibited conduct
When using this service, you must not:
- Attack, circumvent, damage or test security mechanisms without authorisation.
- Use bots, scripts or other automated tools for unauthorised large-scale scraping or abusive requests.
- Attempt to obtain other users’ account, payment or private data.
- Use the service for fraud, harassment, threats, unlawful surveillance, illegal gambling or other unlawful activities.
- Interfere with normal system operation or impose an unreasonable load on the infrastructure.
Service availability and changes
We make reasonable efforts to keep the service operational but do not guarantee permanent, uninterrupted or entirely error-free availability. Maintenance, updates, network faults, third-party service interruptions, security incidents or force majeure may cause temporary unavailability.
We may adjust features for security, legal, technical or product improvement reasons. Where consumers have purchased services that have not yet been fulfilled, we will not use unilateral changes to these Terms to deprive them of rights already acquired by law.
Scope of liability
To the extent permitted by applicable law, Falpes SARL is not responsible for decisions users make independently after treating entertainment-based divination results or AI content as facts, professional advice or guarantees about the future.
We do not assume liability beyond that required by law for third-party network interruptions beyond our reasonable control, user device issues, user errors, force majeure or unauthorised external attacks themselves.
Nothing in these Terms is intended to exclude or limit liability under applicable consumer law, statutory product or digital content guarantees, liability for fraud or wilful misconduct, or any other liability that cannot lawfully be excluded or limited.
Account deletion and termination of service
Users may request account deletion through the features provided on the website. Deleting an account does not affect lawful payment obligations incurred before deletion, dispute handling, fraud prevention needs or accounting and transaction records that must be retained by law.
We may suspend or terminate access if a user seriously breaches these Terms, engages in unlawful conduct, fraud or security attacks, or persistently abuses the service. Consumer rights already acquired by law remain protected under applicable law.
Governing law and disputes
These Terms are generally governed by French law. However, this does not deprive consumers residing in other countries or regions of the rights granted to them by applicable mandatory consumer protection rules.
If a dispute arises, please first submit a complaint to our contact email address so that we can attempt an amicable resolution. Consumers may bring proceedings before a court with jurisdiction under applicable law. These Terms do not compulsorily deprive EU consumers of the jurisdictional protections they lawfully enjoy in their place of residence.
Consumer mediation
If a consumer has first submitted a written complaint to Falpes SARL and the dispute remains unresolved, the consumer may, in accordance with the law, request the intervention of our designated consumer mediation body free of charge.
Before launch, enter here the name, postal address and website of the French consumer mediation body with which you have actually contracted and registered.
